Course Reserves
The HJF Library offers both physical and electronic reserves (e-reserves). Both reserve options must comply with the following copyright policies of Morningside College.
"The use of copyrighted materials, such as films, videos, filmstrips, electronic media, etc./ for public performance must comply with the Federal Copyright Act (Title 17, United States Code, Section 101 and following), Digital Millennium Copyright Act (DMCA), and Technology, Education and copyright Harmonization Act (TEACH). Copyrighted materials used for educational purposes in a classroom setting must comply with the Fair Use Guidelines of the Copyright Act which may be found in the Copyright Act at Section 107. Further copyright exceptions for academia are found in Sections 108 (reproduction by libraries and archives), 109 (first sale), and 110 (use of materials in an educational setting). Copyrighted materials used for recreational purposes as public performance, outside of the private sphere of one’s home, are required to obtain a public performance license."
The library uses the following four factors as outlined in Section 107 of the U.S. Copyright Act to determine whether or not an item is eligible for reserves.

- Nature of the work being used
- The amount being used
- The effect of using the material on the market

Faculty and instructors may place physical books, journals, journal articles, videos, audio and other materials on reserve.

- 2 Hour Reserve
- 1 Day Reserve (24 Hours)
- 3 Day Reserve (72 Hours)

Electronic Reserves (e-reserves)
Faculty and instructors may have materials placed on electronic reserves in order to make those materials digitally available to the students in the course.
General Guidelines for Scanning and/or Copying Resources for Electronic Reserve
If the resource does not meet these requirements, the library may determine that copyright clearance is necessary before making the resource available. If copyright clearance needs to be purchased, the library, within reason, will cover the cost of purchasing the item or paying for copyright clearance.
General Guidelines for Scanning and/or Copying Resources for Electronic Reserve
- Items that have been legally purchased by the library, department, college, or instructor of the course.
- One article per issue of a journal, newspaper or magazine.
- One chapter from a book.
- An excerpt from a work of prose that is less than 10% of the entire work.
- One image (graph, chart, photo, etc.) per book, journal or magazine issue only.
If the resource does not meet these requirements, the library may determine that copyright clearance is necessary before making the resource available. If copyright clearance needs to be purchased, the library, within reason, will cover the cost of purchasing the item or paying for copyright clearance.
